In the following weeks, you will be required to complete a work capability questionnaire or form ESA50. This asks for a description of how your medical conditions affect you, and we strongly recommend that you have good quality help with this. You need to know where they are coming from, and in some parts, the form does not ask the right questions. A properly completed form is the foundation for getting the right outcome on your claim.
You are the expert on you, but you live with your difficulties every day and have found ways around many of your limitations, so you may not think to include in your questionnaire all that the Department needs to understand.
Many of the tribunal appeals we do are with clients who did their own ESA50 and Mandatory Reconsiderations and although I think that it is the wrong question, tribunals regularly ask clients why something that we have included at the appeal stage was not included by them in the capability for work questionnaire. We don’t think that tribunals should reasonably expect a claimant to have the same understanding of what is required or what parts of the test mean, as they or a specialist adviser has, but the question still gets asked. You can avoid this by getting specialist help from us from the start.
To use our service, you need only sign the declaration in the ESA50 and post it to us, with the return envelope. On receipt, we will agree a day and time with you for completing it over the phone, and if that needs to be done outside of office hours or at the weekend, we can fit in with you. Send any reports or letters that you think may help. Once the form is completed and we know how you should qualify, then we can assess how helpful this material is to your pip claim. We have seen tribunals home in on negative material in letters, reports and GP records that the client sent in before instructing us, not realising its significance, but we can avoid this. The completed form is posted ‘signed for’ and if the date for returning it is tight, it will go Next Day Guaranteed Delivery. We keep a copy of the form on your file and you get a copy through the post from us, with detailed written advice on where you should score points on your ESA claim, how strong a claim you have for those points and whether you should qualify for the work-related activity group or the support group.
When you have a date for your face-to-face assessment, let us know, as there is information and advice you should have on how best to handle that meeting and avoid some of the potential pitfalls. You get an information sheet about this with your advice letter, but inevitably, that advice is different depending on whether your pip claim is based on physical difficulties, overwhelming fatigue or mental health problems.

I have been dealing with Disability Claims for many years for help with claiming the right benefit. They helped me a great deal, particularly when the DWP got it very wrong. They were confident and reassuring that I was in the right and we won no problem on appeal. You can be as genuine as possible, with real issues but often it's how those words are put over - this is where Disability Claims came in.
