PIP Claim
A properly completed pip claim form is the foundation for getting the right outcome on your claim, whether you end up with the right award when your claim is first dealt with, after a Mandatory Reconsideration or an appeal to an independent tribunal. You need to know where the Healthcare Professional and Decision Maker are coming from, as well as what the law says the words and phrases in the test mean.
We will avoid you including irrelevant content, making sure that the pip claim includes all that the Decision Maker needs to see, by asking you questions that you probably would not ask yourself.
You are the expert on you and how your medical conditions affect you, but you live with your difficulties every day and have found ways around many of your limitations, so you may not think to include in your pip claim all that the Department needs to understand.
Many of the tribunal appeals we do are with clients who did their own claims and Mandatory Reconsiderations and although we think that it is the wrong question, tribunals regularly ask clients why something that we are claiming at the appeal stage was not included by them in their pip claim form.
We don’t think that tribunals should reasonably expect a claimant to have the same understanding of what is required or what parts of the test mean, as they or a specialist adviser has, but the question still gets asked. You can avoid this by getting specialist help from us from the start.
To use our service, you need only sign the declaration in the pip claim form and post it to us. On receipt, we will agree a day and time with you for completing it over the phone, and if that needs to be done outside of office hours or at the weekend, we can fit in with you. Send any reports or letters that you think may help.
Once the form is completed and we know how you should qualify, then we can assess how helpful this material is to your pip claim. We have seen tribunals home in on negative material in letters, reports and GP records that the client sent in before instructing us, not realising its significance, but we can avoid this. The completed form is posted ‘signed for’ and if the date for getting it back to PIP is tight, then it will go Next Day Guaranteed Delivery. We keep a copy of the form on your file and you get a copy through the post from us, with detailed written advice on where you should score points on your pip claim, how strong a claim you have for those points, what award you should get on the claim and what award you should settle for.
When you have a date for your face-to-face assessment, let us know, as there is information and advice you should have on how best to handle that meeting. You get an information sheet about this with your advice letter, but inevitably, that advice is different depending on whether your pip claim is based on physical difficulties, overwhelming fatigue or mental health problems. The Healthcare Professional is more likely to understand some types of needs than others and we give advice tailored to your pip claim.
When you have the decision on your claim, we are happy to provide advice on whether it is the right award, and your options. You may be able to get extra amount included in benefits you already receive, triggered by the award on your pip claim, and advice on this is included. PIP ASSESSMENT
Your PIP claim, whether a fresh claim or for a move from DLA to PIP, is very likely to involve a face-to-face assessment. Yes, the PIP claim form asks for details of medical people who are or have recently been treating you, and for any medical evidence you have, but in my experience, it is rare for the Department to contact anyone. PIP DECISION
You would not be reading this if you were happy with what is in your decision letter. In a perfect world, you would be able to say to yourself that if you were refused benefit or if you were awarded less than you hoped for, then it must be because you just didn’t meet the criteria; that the Department for Work & Pensions must know what they are doing. PIP RECONSIDERATION
You would probably not be reading this if you were happy with the PIP decision letter. The first thing to remember is that if it is wrong, we can almost certainly put it right, so do not panic. PIP APPEAL
You must have received your mandatory reconsideration notice before you can put in an appeal to an independent tribunal. It is better to use the standard SSCS1 appeal form, but the rules say that a letter is acceptable, as long as it includes all the necessary information. I have been dealing with Disability Claims for many years for help with claiming the right benefit. They helped me a great deal, particularly when the DWP got it very wrong.
